§ 1. Definitions
For the purpose of these regulations, the following capitalized words or expressions used in this document
shall have the following meaning:
- CD Projekt RED – a joint-stock company under the business name of CD Projekt S.A., with its registered seat in Warsaw at ul. Jagiellońska 74, postal code 03-301, entered in the Register of Entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, 13th Economic Division of the National Court Register under the number KRS: 0000006865, NIP: 734-28-67-148, REGON: 492707333, with fully paid-in share capital of PLN 94,95,000.
- Website – an information and contact-based website intended for adult users, related to the subject of ‘The Witcher’ series games produced by CD Projekt RED and concerning information on CD Projekt RED, located at http://www.thewitcher.com, owned, administered and hosted by CD Projekt RED.
- Regulations – these regulations.
- Forum – an online discussion board that is a part of the Website, intended for the exchange of information and opinions related to the Website’s content, containing information on CD Projekt RED and the games produced by CD Projekt RED.
§ 2. General Information
Acting in accordance with Article 8 sec. 1 item 1 of the Act on Electronic Provision of Services of 18th July 2002 (Journal of Laws Dz. U. of 2002, No. 144, item 1204, as amended), CD Projekt RED establishes the Regulations determining the rules that govern the functioning of the Website and the electronic provision of services as well as the conditions of concluding and terminating agreements on electronic provision of services.
The Users are obligated to familiarize themselves with the provisions of the Regulations before they start using the services covered by the Regulations.
Using the services covered by the Regulations is equivalent to approval of their provisions.
Using the services covered by the Regulations is voluntary and free of charge.
When using the services covered by the Regulations, the User is obligated to follow the generally applicable legal regulations, ethical norms, principles of social coexistence and provisions of the Regulations.
The Users are not allowed to submit any unlawful content to the Website which means that any such content is strictly forbidden.
The Regulations are made available free of charge and the Users can obtain, recreate and record the contents of the Regulations, via the ICT system, as defined in Article 2 item 4 of the Act on Electronic Provision Services of 18th July 2002 (Dz. U. of 2002, No. 144, item 1204, as amended), used by the Users.
The entire Website, including the particular elements of its content, especially its name, idea, graphics, software and database are subject to legal protection.
§ 3. Services
An agreement on electronic provision of services is concluded with CD Projekt RED by the User as of the moment of starting the use of services provided electronically by CD Projekt RED.
The electronic provision of services by CD Projekt RED takes place on two levels, depending on whether the use of the services covered by the Regulations requires the Users to register on the Website or not.
The use of the services provided electronically by CD Projekt RED within the Website by the Users who have
not registered on the Website includes the ability to:
- browse the content of the Website;
- browse the content of the Forum;
The use of the services provided electronically by CD Projekt RED within the Website by the Users who
registered on the Website includes the ability to:
- browse the content of the Website;
- browse the content of the Forum;
- comment on the posts on the Forum;
- publish comments on the Forum;
- subscribe to the Newsletter.
The agreement on electronic provision of services by CD Projekt RED within the Website for the Non-registered Users is concluded for an indefinite term and terminated through withdrawing from the use of the Website.
The agreement on electronic provision of services by CD Projekt RED within the Website for the Registered Users is concluded for an indefinite term. The Registered Users can terminate the agreement on provision of services by CD Projekt RED at any time, with immediate effect, by contacting the Administrator of Forum. The Registered Users who would like to terminate the Newsletter Subscription only can do so at any time, with immediate effect, by using the Unsubscribe option.
CD Projekt RED reserves the right to terminate the electronic provision of services at any time. All users shall be informed about such decision with at least one week notice by an official announcement on the Website and the Registered Users additionally by appropriate e-mail notification send to the e-mail address entered on the Registration Form.
If a Registered User violates the provisions of the Regulations, CD Projekt RED reserves the right to deprive such User of the possibility to use the Website, or to limit their access to the whole or a part of the Forum functionalities. Additionally, CD Projekt RED reserves the right to delete any content violating the Regulations in any way, without prior notice to the User who submitted such content. User is entitled to file a complaint every time, according to the Regulations herein.
CD Projekt RED shall not be liable for any content submitted by the Users.
Publishing any content on the Website is equivalent to making it publicly available.
It is forbidden to use the Website improperly or in a manner contradictory to the purpose of the Website.
It is forbidden to include any violent, hateful or pornographic content, including racial, cultural or religious discrimination and content violating both Polish and international legal and moral standards in the posts or comments placed on the Website.
It is forbidden to include any content that violates the personal rights or offends dignity of other persons, as well as content that violates the copyrights of third parties on the Website.
It is forbidden to distribute junk e-mails and unsolicited commercial e-mails and to run a commercial and advertising activity.
Subject to the provisions of the consumers law, in so far as it is permitted under the applicable law and subject to Article 473 sec. 2 of the Civil Code (Journal of Laws Dz. U. of 1964, No. 16, item 93, as amended), CD Projekt RED is not liable for the Users’ commitment of forbidden actions specified by the Regulations and by the generally applicable legal regulations as well as for the unavailability of the Website services, temporary technical breaks in the functioning of this service including technical problems due to reasons beyond the control of CD Projekt RED.
§ 4. Registration
In order to register to the Website services the User should fill the Registration Form on the Website correctly and truthfully.
The correct completion of the Registration Form requires the User to accept the Regulations and agree to the processing of personal data in order to use the services covered by the Regulations, in accordance with the conditions set out in the Regulations. Providing the personal information is voluntary, however the lack of such prevents from the use of the services provided electronically by CD Projekt RED for which the registration is required.
In order to use the Newsletter service it is necessary for the User to express an additional agreement in the Registration Form to receive information provided by the Newsletter service, including information of commercial nature.
The correct completion of the Registration Form means that the Registered User receives a personal account
generated by the Website.
- It is forbidden to have more than one account on the Website.
- It is forbidden to provide access to the Website through the Registered User’s account to any other persons.
- It is forbidden to use the Website services from the accounts of any other persons.
The Registered User is solely liable for correctness, content and form of the provided personal data and information. It is forbidden to include false and untrue personal data or information.

The provision of personal data is voluntary.
§ 5. Technical Conditions
Action or activities that may hamper or destabilize operation of the Website, including actions or activities preventing use of the Website by other Users, action or activities in form of interference with the contents or the technical nature of the Website are forbidden.
In case of planned ongoing servicing and maintenance of the server or software supporting the operation of the Website, CD Projekt RED reserves the right to a technical break in the functioning of this service.
§ 6. Personal Details
Provision of the personal data is voluntary, however the lack of such prevents from the use of the services provided electronically by CD Projekt RED for which the registration is required.
Users, who provided their personal information may review, update, correct or delete the personal data.
By registering on the Website, the User concludes an agreement on electronic provision of services with CD Projekt RED which shall constitute grounds to process the personal information provided in the Registration Form within the meaning of the Personal Data Protection Act of 29th August 1997 (Journal of Laws Dz. U. 1997, No. 133, item 833, as amended) for the purpose of correct use of the services covered by the Regulations. In case of Newsletter or questions on consent to process the personal information for marketing purposes, the personal data shall be processed by CD Projekt RED only after an appropriate consent has been granted (in case of Newsletter, it can be done by clicking on the activation link sent with the subscription confirmation).
The personal information entrusted to CD Projekt RED is stored and secured in accordance with the regulations set out in the applicable laws.
§ 7. Complaints
Users can file complaints in case of reservations concerning the services covered by the Regulations.
Users can file complaints by sending them to the following address: CD Projekt RED S.A., ul. Jagiellońska 74, 03-301 Warsaw. CD Projekt RED is the entity authorized to consider complaints.
Complaints should include most of all the subject-matter of the complaint together with its justification.
Complaints shall be considered immediately but not later than within 14 days as of their receipt. A response to the complaint is sent by CD Projekt RED to the User to the e-mail address indicated by the User in the correspondence.
§ 8. Final Provisions
The Regulations shall be in force as of their publication.
It is possible to contact CD Projekt RED via the contact form on the Website at http://en.thewitcher.com/support/.
CD Projekt RED reserves the right to amend the Regulations. Amendments to the Regulations shall enter into force after 14 days of their publication on the Website. The Registered Users are informed each time about any amendment to the Regulations via e-mail message sent to the address the User provided in the Registration Form, at least 14 days before the said amendments enter into force. If the user does not agree to a new wording of the Regulations, the User should refrain from using the Website and terminate the use of the services provided electronically by CD Projekt RED and covered by the Regulations.
To all matters not governed in the Regulations, provisions of the generally applicable legal regulations shall apply, in particular provisions of the Act on Electronic Provision of Services of 18th July 2002 (Journal of Laws Dz. U. of 2002, No. 144, item 1204, as amended).
§ 9. Cookies Policy
1. The present Cookies Policy is based on the requirement of law arising from the Act of July 16, 2004, the Telecommunications Law (as amended).
2. Terms used in the present Cookies Policy have the following definitions:
a. Administrator – the Website owner, that is to say, CD Projekt S.A., with its seat in Warsaw (postal code: 03-301, ul. Jagiellońska 74), entered in the Register of Entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under number KRS: 0000006865, NIP: 734-28-67-148, REGON: 492707333, with fully paid-in share capital of PLN 94,950,000
b. User – every person (an internet) navigating the Website (and all the subpages) where the Service is available.
c. Cookies Policy – the present document.
d. Service – the Website under the domain of www.cyberpunk.net
e. Cookies – computer data – especially text files – stored in the Service User’s terminal equipment, intended for the use of the Service sites. Usually cookies include the name of the Website they come from, time of storage at the terminal equipment and an unique identification number.
3. Administrator informs that the Service collects only the information contained in the cookies files, and does not collect any other information about the User. In particular, Administrator declares that the Service does not use so called “tracking cookies”, that is to say the files that allow tracking Users.
4. Service Administrator informs that the cookies are used for the following purposes:
adapting a Website content to the preferences of the Service User and optimising the use of Web pages. In particular, these files allow to identify the User’s device and properly display a Website customised to their individual needs.
maintaining a User’s session (if logged in), which means that the User does not have to log in again on every subpage of the Service.
producing statistics that are the basis for the analysis of ways of the use of websites by Users.
5. Administrator informs that the Service uses two types of cookies:
Session cookies, that is to say – temporary files stored in a User’s terminal equipment until the User logs out, leaves a website or closes a web browser.
Persistent cookies, that is to say, files that will remain in a User’s terminal equipment until their set expiry date, unless deleted by the User.
6. Administrator informs that the Service uses the following types of cookies:
Those that allow the use of the services available within the Service, such as authentication cookies used for services that require Authentication in the Website Service.
Those that are designed to ensure safety e.g. cookies used to detect abuse of authentication features within the Services.
Those that enable collecting information on the forms of using the Service Website pages.
Those that allow storing settings selected by the User and personalising the User interface, e. g. selected language or region from which a User originates.
Those that allow providing Users with advertising content more tailored to their interests (advertising cookies).
8. Detailed information about options and ways of handling cookies are available at a web browser settings.
10. Cookies placed in a User’s terminal equipment can be used by advertisers and business partners cooperating with the Administrator.
