Yes, they could have done anything. There is no absolute reason why there has to be magical items at all. All the magic could be bound up in talents.
The developer intention excuse is no argument against anything. You can't stop a person from having their preferences just because someone intends something different. Gameplay as it was intended to be is not an absolute.
The realism angle doesn't apply here. Puny merchants carrying WMD is not any more realistic than walmart selling RPGs and tanks. The realistic way to deal with powerful magic is to have a relatively few people understand and practice it. In a setting such as TW2, that means that mages are the arms manufactures for any arms and armor of consequence. You don't find such items sitting around where anybody can stumble on them. Or, they would be long gone before you got there. You'd better be strong enough to hold onto them because every crook and thug will be after your prize possessions. Laredo would strip you bare the first chance he got. No doubt one of the goons carrying out the attack would dethrone him soon after. It would never end.
